The Nisshoki flag is the national flag since the law on the national flag and anthem, enacted and effective since 13 August 1999. Although there is no previous legislation designating it as the national flag, it is already regarded as the de facto national flag of Japan. Indeed two proclamations were issued in 1870 by the Daijō-kan, the governmental body at the beginning of the Meiji era, each having a provision on the composition of the national flag. A flag with a sun disc was adopted as the national flag for merchant ships under Proclamation No. 57 of Meiji 3 (issued February 27, 1870), and as the national flag used by the Navy under Proclamation No. 651 of Meiji 3 (issued October 27, 1870). The use of the Hinomaru was severely restricted during the beginning of the American occupation after World War II even if these restrictions were eased thereafter.
